kusp - Terms of Service

1. ACCEPTANCE OF TERMS & INTRODUCTION

By downloading, accessing, or using the mobile application, website, and related services operated under the kusp brand (collectively, the “Service” or “Services”), you agree to be bound by this Terms of Service Agreement (the “Terms” or “Agreement”). If you do not accept and agree to be bound by all of the terms of this Agreement, you should not access or use the Service.

2. ACCOUNT ELIGIBILITY & MEMBER RESPONSIBILITIES

By creating an account and using the Service, you represent and warrant that:

  • You are an individual at least 18 years of age.

  • You are legally qualified to enter into a binding contract with kusp.

  • You are not barred from using the Service under the laws of the United States or any other applicable jurisdiction.

  • You will comply with this Agreement and all applicable local, state, national, and international laws, rules, and regulations.

  • You have never been convicted of, or pled no contest to, a felony, a sex crime, or any crime involving violence or threat of violence.

  • You will maintain the confidentiality of your account login credentials and are solely responsible for all activities that occur under your account.

3. CONTENT & MEMBER CONDUCT RULES

kusp strives to maintain a respectful and authentic community. You agree that you will not:

  • Misrepresent your identity, age, or affiliations with any person or entity.

  • Harass, bully, stalk, intimidate, assault, defame, or mistreat any user or kusp personnel.

  • Use the Service for any illegal, unauthorized, or commercial purpose, including soliciting money or goods from other users.

  • Post or share content that is hateful, threatening, sexually explicit, abusive, or incites violence.

  • Attempt to reverse-engineer, decompile, crawl, or hack the platform, including attempts to bypass system thresholds (such as the 25-link visibility gate or 5-link batch updates).

  • Use automated scripts, bots, scrapers, or third-party tools to interact with the Service without our express written consent.

4. SAFETY, ACCOUNT TERMINATION & DATA DELETION

We are committed to maintaining a safe community. kusp uses automated systems and human review to monitor compliance with these Terms. We reserve the right to investigate and take appropriate action—including content removal, account suspension, or permanent account termination—if you violate these Terms or misuse the Service.

You have the right to close your account at any time through the in-app settings or by contacting support. Upon account closure, your personal data, profile details, and tier placements will be deleted in accordance with our Privacy Policy. In alignment with our Privacy Policy, we implement a safety retention window of up to 90 days following account closure to investigate potential unlawful or harmful conduct before permanent deletion, except where limited transactional, security, or legal records must be retained for statutory compliance.

5. PRIVACY & DATA HANDLING

Your privacy is important to us. For information about how kusp collects, uses, and shares your personal data, please review our Privacy Policy. By using our Service, you agree that we can use such data in accordance with our Privacy Policy.

6. RIGHTS GRANTED TO YOU BY KUSP

kusp grants you a personal, worldwide, royalty-free, non-assignable, non-exclusive, revocable, and non-sublicensable license to access and use the Service strictly as intended and permitted by these Terms. All proprietary rights, trademarks, brand names, and app interfaces remain the exclusive property of kusp.

7. RIGHTS YOU GRANT TO KUSP

By creating an account, you grant kusp a worldwide, transferable, sublicensable, royalty-free right and license to host, store, use, copy, display, reproduce, adapt, edit, publish, modify, and distribute information you authorize us to access (including contact selections and profile details) strictly for the purpose of operating, developing, providing, and improving the Service.

8. PURCHASES & AUTOMATICALLY RENEWING SUBSCRIPTIONS

kusp may offer paid features, products, or automatically renewing subscriptions (“Paid Services”):

  • Billing: If you purchase a subscription or paid feature, payment will be charged to your Apple ID or Google Play account at confirmation of purchase.

  • Automatic Renewal: Subscriptions automatically renew for the applicable subscription period and price unless canceled at least 24 hours prior to the end of the current billing period.

  • Cancellation: You can manage or cancel your subscription at any time by accessing your App Store or Google Play account settings after purchase. Refunds are handled in accordance with Apple App Store and Google Play Store policies.

9. DISCLAIMERS OF WARRANTIES

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. KUSP EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. KUSP DOES NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY RELATIONSHIP OUTCOMES WILL BE ACHIEVED.

10. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KUSP, ITS AFFILIATES, EMPLOYEES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.

11. DISPUTE RESOLUTION & BINDING ARBITRATION

Except where prohibited by law, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be settled by binding individual arbitration rather than in court. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against kusp.

13. MODIFICATIONS TO TERMS

kusp reserves the right to modify, amend, or update these Terms from time to time. We will notify you of material changes before they take effect through the app or by other reasonable means. Your continued use of the Service after any modified Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and close your account.

14. SEVERABILITY & ENTIRE AGREEMENT

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed or reformed to the minimum extent necessary to make it valid and enforceable, and the remaining provisions of these Terms shall continue in full force and effect. These Terms constitute the entire agreement between you and kusp regarding the use of the Service.

15. GOVERNING LAW & CONTACT INFORMATION

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.
